One of the benefits you are entitled to as a worker is the payment of **Workers' Participation in Company Profits (PTU)**, better known as **Profit Sharing**.
Profit sharing is the right of every Mexican worker, enshrined in **Article 123 of the Constitution**, to receive a portion of the earnings obtained by a company or employer from its productive activity or the services it provides.
All workers employed by a natural or legal person, who receive a salary in exchange for their work and who have worked **more than 60 days** during the year, are entitled to collect profit sharing.
Workers who were employed for less than 12 months are also entitled to profit sharing, but in these cases the payment will be **proportional** to the number of days actually worked.
It is common to wonder on what date profit sharing will be paid; this depends on whether you work for a company or directly for an individual employer.
For people who work for a **legal entity** (a company), profit sharing must be paid no later than **June 29**.
For people who work for a **natural person** (an individual employer), profit sharing must be paid no later than the **last day of May**.
One of the key elements of profit sharing is the creation of a **Joint Profit Sharing Commission**. Setting it up is, first and foremost, a legal requirement, and its role is to draft the individual profit-sharing plan for each worker based on the tax return filed by the company or employer.
There is no cap on the number of members of this Commission, but it must be made up of an **equal number of representatives** from the workers and from the company. It is worth noting that **trust-position employees may not** represent the workers on the Joint Commission.
When a company does not generate profits, which is common for newly created firms, the company is encouraged to grant a **compensatory bonus** to its workers to recognize the commitment, effort and dedication they bring through their daily work.
